Welcome to braintute.com. These Terms of Service govern your use of our website and LMS development services. By accessing or using our services, you agree to abide by these terms.

1. Service Plans and Development Timeline:

Braintute.com offers three service packages: Basic, Business, and Enterprise. Based on your needs, you can select the perfect plan. Development will commence once you select and complete the payment for your preferred plan. The LMS + website will be launched within 30 days from the date of payment.

2. User Accounts:

To access certain features of our services, you may need to create a user account. You are responsible for maintaining the confidentiality of your account credentials.

3. Use of Services:

You agree to use braintute.com for lawful purposes only. You will not engage in any activity that violates local, national, or international laws and regulations.

4. Cost and Revenue Model:

BrainTute operates on a revenue-sharing model:

X% of student payments go to the Instructor/Institution, and the total revenue will be received directly into their account at the time of payment.

Y% of the revenue is owed to BrainTute for maintenance, and service fees.

On the 1st of every month, BrainTute will issue an invoice to the Instructor/Institution for its Y% share for the previous month, which must be settled within 5 days to ensure uninterrupted LMS and web services.

5. Intellectual Property:

All content, code, designs, and materials provided as part of our website and LMS development services are the intellectual property of braintute.com and are protected by applicable copyright and trademark laws.

6. Prohibited Activities:

Users are prohibited from engaging in activities that disrupt the normal operation of our services, including but not limited to hacking, unauthorized access, data scraping, or the distribution of malware.

7. Online Session Licensing:

We provide one Zoom Pro, Business, or a custom license (based on your selected plan) free of charge. If additional licenses are required, you can be purchased at an additional cost.

8. Payment and Subscription:

An advance subscription fee, based on the selected plan, will be charged at the start of development and adjusted against the first month’s payment.

A flat monthly subscription fee is applicable for maintaining your LMS and website; however, if your total monthly revenue meets or exceeds the revenue threshold defined in your plan, this fee will be waived, allowing you to operate without fixed monthly costs.

9. Project Completion & Delivery:

Once development is complete, the LMS + website will be delivered within the 30-day timeframe. Institute/Instructor are responsible for reviewing and testing the platform before final approval.

10. Termination of Services:

Braintute.com reserves the right to terminate or suspend services if any terms are violated or if there is a failure to make timely payments for ongoing services.

11. Limitation of Liability:

Braintute.com is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services. Users assume all risks associated with the deployment and operation of their LMS + website.

12. Changes to Terms of Service:

Braintute.com reserves the right to update these Terms of Service at any time. Changes will take effect immediately upon posting on our website.
